divonis bersalah, dua terdakwa korupsi di distan oku menerima. ini kasusnya                               palembang, sumateraekspres.id - majelis hakim pengadilan tipikor palembang dipimpin hakim ketua efiyanto sh mh menjatuhkan vonis yang berbeda kepada kedua terdakwa kasus korupsi pengelolaan dana bantuan program optimalisasi lahan rawa (oplah) pada dinas pertanian oku, kemarin (26/9). 
akibat tindak korupsi yang dilakukan oleh kedua terdakwa mengakibatkan kerugian nnegara senilai rp264.860.000.

kedua terdakwa, agus paharyono selaku tim teknis yang juga berstatus sebagai pns dijatuhi vonis selama 1,5 tahun penjara sedangkan hendra haryadi yang merupakan tenaga kerja sukarela (tks) pada dinas pertanian oku divonis 1 tahun penjara.
kedua terdakwa divonis atas kasus korupsi terkait pengelolaan dana bantuan program oplah pada dinas pertanian kabupaten ogan komering ulu pada tahun anggaran 2020, yang menyebabkan kerugian negara sebesar rp 264.860.000.
dalam amar putusannya, majelis hakim menyatakan kedua terdakwa terbukti secara sah dan meyakinkan bersalah karena secara bersama-sama melakukan tindak pidana korupsi, sebagaimana diatur dan diancam pidana dalam pasal 3 jo. pasal 18 undang-undang no. 31 tahun 1999 yang telah diubah dengan undang-undang no. 20 tahun 2001 tentang pemberantasan tindak pidana korupsi, jo. pasal 55 ayat (1) ke-1 kuhp.
"mengadili dan menjatuhkan pidana penjara terhadap terdakwa hendra haryadi dengan hukuman penjara selama 1 tahun serta denda sebesar rp 50 juta, subsider 1 bulan.
sedangkan terdakwa agus paharyono dijatuhi hukuman penjara selama 1 tahun 6 bulan serta denda sebesar rp 50 juta, subsider 3 bulan," sebut efiyanto saat membackan putusannyam di persidangan, kemarin (26/9).
tak hanya menjatuhkan vonis pidana penjara, terhadap kedua orang terdakwa, majelis hakim juga membebankan pembayaran uang pengganti (up) kepada para terdakwa, masing-masing terdakwa hendra haryadi dibebankan membayar sebesar rp25 juta. 
yang apabila tidak mampu membayar, ia akan dikenakan pidana tambahan selama satu bulan penjara. sedangkan terdakwa agus paharyono dibebankan untuk membayar up sebesar rp175 juta yang apabila tidak mampu membaya diharuskan menjalani pidana tambahan selama 2 bulan.
usai mendengar pembacaan putusan, kedua terdakwa menyatakan menerima keputusan tersebut. sementara itu, jaksa penuntut umum (jpu) menyatakan akan mempertimbangkan untuk mengajukan banding.

pada persidangan sebelumnya dengan agenda pembacaan tuntutan, jpu menuntut terdakwa agus paharyono dengan pidana penjara selama 2 tahun 3 bulan dan denda sebesar rp 50 juta, subsider 3 bulan.
sedangkan hendra haryadi dituntut dengan pidana penjara selama 1 tahun 6 bulan dan denda sebesar rp 50 juta, subsider 6 bulan.(dil/kms)
