korupsi berjemaah, kejari oki tahan 2 tersangka baru korupsi pades bukit batu                            kayuagung, sumateraekspres.id – kejaksaan negeri (kejari) oki, menetapkan 2 tersangka baru kasus dugaan korupsi pengelolaan pendapatan asli desa (pades) plasma sawit desa bukit baru, kecamatan air sugihan, tahun 2015-2021. penyidik pidana khusus (pidsus) langsung melakukan penahanan tersangka p dan b, selasa, 5 maret 2024.
diketahui, p merupakan sekretaris desa (sekdes) bukit batu. sedangkan p, kaur perencanaan dan keuangan desa bukit batu periode 2007-2021. keduanya ditahan, menyusul tersangka asmadi, mantan kades bukit batu, yang sudah ditahan lebih dulu sejak 22 desember 2023 lalu.
“penetapan dan penahanan kedua tersangka baru ini, atas pengembangan penyidikan lanjutan perkara mantan kepala desa bukit batu periode tahun 2015-2021,” terang kepala kejari oki hendri hanafi sh, melalui kasi pidsus eko nurlianto sh, kemarin.
dari hasil pengembangan penyidikan, pihaknya telah menemukan 2 alat bukti yang cukup terkait perbuatan kedua tersangka (p dan b), terkait pengelolaan hasil kerja sama sawit plasma di atas tanah kas desa bukit batu seluas 205 hektare.

“kedua tersangka ini seharusnya melakukan pengelolaan hasil pades setor ke kas desa, ini malah diserahkan pada tersangka as (asmadi)," jelas eko. sehingga dalam perkara ini, begara mengalami kerugian rp9,6 miliar.
penahanan kedua tersangka p dan b, berdasarkan surat perintah penahanan nomor:print-02 dan 03 /l.6.12/fd.1/03/2024, tanggal 5 maret 2024. “maka 2 tersangka p dan b langsung dilakukan penahanan selama 20 hari ke depan, guna mempercepat proses hukum selanjutnya,” sambungnya. 
kedua tersangka p dan b dititipkan penahanannya, di lapas kelas iib kayuagung. “untuk menghindari dan  kekhawatiran 2 tersangka akan melarikan diri, merusak atau menghilangkan barang bukti dan atau mengulangi tindak pidana sebagaimana diatur pada pasal 21 ayat (1) kuhap,” tegas eko. 
meski penyidik pidsus kejari oki telah melakukan penahanan terhadap 3 orang tersangka, namun eko menyebut pihaknya akan terus mendalami alat bukti terkait keterlibatan pihak-pihak lain yang dapat dimintakan pertanggungjawabnnya.

terhadap tersangka ini, dikenakan pasal 2 ayat (1) dan atau pasal 3 jo pasal 18 uu pemberantasan tindak pidana korupsi, jo pasal 55 ayat (1) ke-1 kuhp. seperti diketahui, sebelumnya penyidik tidak hanya menahan tersangka asmadi.
tapi tanah dan bangunan milik tersangka asmadi di kompleks perumahan lavender, kabupaten banyuasin, juga telah disita. “diduga hasil tindak pidana korupsi pada penyalahgunaan pades tersebut,” ucap eko.
penyitaan aset itu berdasarkan surat perintah penyitaan dari kajari oki hendri hanafi sh mh, dan penetapan izin penyitaan dari ketua pengadilan negeri (pn) pangkalan balai. nilai tanah dan bangunan yang dista itu, diperkirakan  rp400 juta hingga rp 500 juta.
konstruksi perkara ini, tanah kas desa seluas 205 hektar, telah ditanami sawit kerjasama dengan pt selatan agro makmur lestari (pt saml). seharusnya hasil plasma tersebut, disetorkan ke kas desa bukit batu. sebagai pendapatan asli desa (pades) bukit batu.

namun faktanya diambil tersangka asmadi selama dia menjadi kades, dan beberapa pihak lainnya. sehingga berdasarkan hasil perhitungan keuangan negara, tersangka asmadi telah merugikan negara sebesar rp9,6 miliar. 
nilai kerugian itu akumulasi dari  hak negara sejak 2015-2021. kerugian negara ini masih berpotensi bertambah, karena tersangka asmadi juga mengklaim masih ada lahan miliknya, di atas tanah yang bersengketa di kebun plasma sawit tersebut.   (uni/air)
